"I am still waiting for an answer by a lawyer."

About what you should do? You have a long wait in store for you.

The personal testimonial of "Togoodhlth" notwithstanding, you might think about what you personally know to be true. You agreed to buy a domain name for $3K. You got the domain name. You have not paid.

If you want to do the absolute failsafe morally and legally right thing, then you might consider paying the $3K and then giving the domain name to whomever you think should have it. That way, you keep your promise and the alleged "rightful" owner gets it.

Or were you looking for a more affordable version of morality?

John, what jurisdiction does this fall under? Neither parties are from the US?
Would UDRP be the decision maker in this case?

John
So you are stating that if, for any reason, I do not want to buy the domai anymore as I have been noticed that it might have been stolen then I should transfer it back to the person who transferred it to me?

If Atillio transfers it to domainp what will he do with it?

1. Transfer it to the original screwed owner - Allen?
2. Give it back to his friend - Mr. Wan?
3. Transfer it to opencg?
4. Put it back on Ebay?
5. Sell it to another?

I don't believe I have to ask about opencg's money. I think that is a done deal but I hope I am wrong.

I say you get godaddy involved, let them be custodian of the domain and sort out who is the owner.

I would suggest holding it for at least another 24hrs. If it were me I would hold it indefinitely until I had all of the answers from all parties and all documentation.

Not sure what laws govern this particular problem however it may be the Universal Domain Resolution Policy...in which case I don't think you have any worries.

Making threats - and putting them in writing - is NOT the sign of anyone who has any respect for ANY law - or morality (besides not being the smartest move...). I mean, what's with the "family in the business" bull? Sounds like a bad movie...LOL

I want to know If I risk any legal action against me if I give back the domain to anyone who the result to be involved in a fraud?

If the "alleged" first owner file a lwa suit to get back his name and they find out I had it in my hand and gave it back to the person (or "friend") who frauded the first owner might I risk to be involved ?

I will make this public so the seller might feel a bit more comfortable.

I bought ouch.com.

The seller accepted to transfer the domain on advance.

I will complete WU payment as soon as possible tomorrow morning and in the unfortunate case I would not be able to do so
(is first time I pay by this way and I am uncertain about their policies here in Mexi) I will immediately push back the domain to the seller.

At this point I have no reason to doubt about the good faith of the seller as he trusted me and as all we know the domain dropped just few days ago.

~~~~~~~~~~~
atti,
seems to me you had untill tomorrow morning to render payment anyway........ what gives seller the right to sell the name again?
you have not breeched or broken any laws or contracts, go with your better judgement and don't let these idiots intimidate you.
can't you see through them ?
Attillo - my opinion is that you should hold it, even if only 24 hours, just to see if you can get the facts, and THEN make a decision. This will hurt no one, and you should not have any legal problems as well. The guy is desperate as if he is found out, he will lose. If he is legit, he too would wait 24 hours to make peace.
I am not intimidate at all.
I will not risk to break the law under any circumstances.
I did not get clear answer to my questions yet.
I ear that I would have to pay for a domain after I have been noticed it might have been stolen. I do not think so.
I do not want to buy it anymore and I want to know according to the law to who I have to give it back.
